By accessing and using KulaSpace ("Service," "we," "us," or "our"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

KulaSpace is a community-driven job search platform that allows users to:

• Join or create support pods for job search support
• Track job applications in a unified dashboard
• Trade skills and services in our marketplace (resume reviews, mock interviews, etc.)
• Share posts, success stories, and job search tips
• Discover and apply to job opportunities
• Manage interviews and compare job offers

3. User Accounts

Account Creation

• You must provide accurate and complete information when creating an account
• You must be at least 18 years old (an adult) to use our service
• We may require identity verification using secure third-party services to verify your identity and prevent fraud
• We use passwordless authentication - you'll receive a secure login link via email
• You may also sign up using OAuth providers (Google, Apple, LinkedIn)
• You are responsible for maintaining the security of your email account
• You must notify us immediately of any unauthorized use of your account
• One person or entity may not maintain more than one account

Account Responsibilities

• You are responsible for all activities that occur under your account
• You must not share your account credentials with others
• You agree to pay all charges associated with your account

4. Acceptable Use

Permitted Uses

Prohibited Uses

You agree not to use the service to:

• Post fake job listings, scams, or fraudulent opportunities
• Harass, bully, or discriminate against other users
• Spam, send unsolicited messages, or abuse the messaging system
• Post illegal, harmful, offensive, or discriminatory content
• Infringe on intellectual property rights or post copyrighted material without permission
• Create fake profiles or impersonate others
• Manipulate reviews, ratings, or marketplace transactions
• Distribute malware, viruses, or malicious content
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with the service, other users' access, or platform security
• Violate any laws or regulations

5. Content and Data

Your Content

• You retain ownership of content you create (posts, check-ins, goals, profile information, etc.)
• You grant us a license to host, store, and process your content to provide the service
• You are responsible for ensuring your content complies with all applicable laws and these terms
• You represent that you have all necessary rights to the content you upload or share
• Content you post in pods is visible to pod members based on pod privacy settings
• You may delete your content at any time, subject to reasonable processing delays

• We may remove content that violates these terms
• We may suspend or terminate accounts that repeatedly violate our policies
• We reserve the right to refuse service to anyone

6. Fees and Payment

Free Platform

• Core features are free forever for job seekers and employers
• No subscription fees, no credit card required
• All features are available to free users
• No hidden costs or premium tiers

Skills Marketplace Transactions

• When you offer services (resume reviews, mock interviews, etc.), we charge a small transaction fee (10%)
• This fee supports platform operations and keeps core features free
• All fees are clearly displayed before you complete a transaction
• Payments are processed securely through trusted payment processors
• We do not store your payment information
• Refunds are handled on a case-by-case basis for service disputes

Payment Processing

• You authorize us to charge your payment method for marketplace transactions
• All payment disputes should be reported through the platform

7. Service Availability

• We strive to maintain 99.9% uptime but do not guarantee uninterrupted service
• We may perform maintenance that temporarily affects service availability
• We are not responsible for internet connectivity issues beyond our control
• We may modify or discontinue features with reasonable notice

8. Intellectual Property

Our Property

• The KulaSpace platform, software, and technology are our property
• Our trademarks, logos, and brand elements are protected
• You may not copy, modify, or reverse engineer our platform

Your Property

• You retain all rights to content you create
• You are responsible for respecting others' intellectual property rights
• We will respond to valid DMCA takedown notices

9. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these terms by reference. By using our service, you consent to the collection and use of your information as described in our Privacy Policy.

10. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability to you for any damages shall not exceed the amount paid by you for marketplace transactions in the 12 months preceding the claim, or $100, whichever is greater
• We are not liable for indirect, incidental, special, consequential, or punitive damages
• We do not warrant that the service will be error-free or uninterrupted
• We are not responsible for job placement outcomes, interview results, or employment decisions
• We are not liable for disputes between users in pods, marketplace transactions, or referrals
• You use the service at your own risk

11. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of the service
• Your violation of these terms
• Your violation of any third party's rights
• Content you submit or transmit through the service

12. Termination

By You

• You may terminate your account at any time through your account settings
• Termination does not relieve you of any payment obligations

By Us

• We may terminate your account for violation of these terms
• We may suspend service for non-payment
• We will provide reasonable notice except in cases of severe violations

Effect of Termination

• Your access to the service will cease immediately
• Your profile, posts, pod memberships, and connections will be removed
• You may export your data before termination (see Privacy Policy for details)
• Pending marketplace transactions will be resolved according to our dispute resolution process
• We will delete your data according to our Privacy Policy (typically within 30 days)

13. Dispute Resolution

Any disputes arising from these terms or your use of the service will be resolved through binding arbitration in Orange County, California, in accordance with the rules of the American Arbitration Association. You waive any right to participate in class action lawsuits or class-wide arbitrations.

14. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any legal actions must be brought in the courts of Orange County, California.

15. Changes to Terms

We may modify these terms at any time by posting the revised terms on our website. Your continued use of the service after any changes indicates your acceptance of the new terms. Material changes will be communicated via email or service notifications.

16. Severability

If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
